As if Usher didn’t have enough trouble, here comes something else. Apparently, his insurance company wants no part of his current herpes lawsuits. According to court documents filed by the New York Marine and General Insurance Company, they feel they shouldn’t have to defend him because he didn’t tell them he was infected.
The company – which submitted the paperwork to the Los Angeles Superior Court on Monday – claims that the policy Usher has with them doesn’t apply to “'bodily injury’…arising out of the transmission of any communicable diseases by insured.” They also say that the policy expressly states that they don’t provide coverage for someone who has intentionally concealed or misrepresented any material fact or circumstance. They also say that he never told them he’d settled a prior lawsuit in 2012 over the same thing.
New York Marine is asking to be excused from the cases against Usher in California and Georgia. They always want to be reimbursed for expenses related to the case. For the record, he hasn’t revealed his herpes status.
